A 27-year-old father from the Cape Winelands has been sentenced to 35 years in prison for creating and distributing child p0rn0graphy involving his own children. The man, whose identity is being withheld to protect the victims, was convicted of a staggering list of offences, including r@pe, child traff!cking, and the possession and distribution of child p0rn0graphy. The convicted man used his minor daughters, aged six and four, and infant son, aged one, to produce the material, which he sold online for financial gain. According to the National Prosecuting Authority (NPA), he committed the crimes while unemployed and staying at home with the children. He married the children’s mother in 2018. He decided to create child p0rn0graphy for financial gain, as the conversion rate at the time was R18 to the dollar, said NPA spokesperson Eric Ntabazalila. He connected with the group after the administrative user approved his access to the group, and he started to communicate with the administrative user. Using a messaging-based social media platform that enabled real-time sharing of images, the man began engaging with others involved in the online exploitation of children. He admitted to creating and distributing s3xually exploitative content involving his own children, receiving between $5 and $10 per sale. His activities were uncovered through an undercover operation by a U.S. FBI task force investigating online child exploitation. Information gathered by the Washington field office was shared with South African authorities, leading to the man’s arrest on May 30, 2023. His cellphone, which contained evidence of the crimes, was confiscated. He was convicted on multiple charges, including two counts of trafficking in persons for online exploitation, four counts of r@pe, three counts of benefiting from child p0rn0graphy, 629 counts of possession of child p0rn0graphy, three counts of unlawful distribution, and three counts of child abuse. Senior state advocate Evadne Kortje, who finalised the plea and sentencing agreement, described the case as a grave violation of parental duty. He abused his parental privilege and the trust relationship he had towards his three small children, she said. He contributed to the s3xualisation of children whose innocence should have been protected and preserved at all costs. Regional court magistrate Gangadu, in delivering the sentence, warned about the growing misuse of modern technology to exploit children and emphasised the severity of the crimes. The sentence includes an effective 35-year direct imprisonment, with a requirement that he serve at least two-thirds before being eligible for parole.
