Controversial businessman Hamilton Ndlovu has hit a legal dead end after the High Court dismissed his application to reinstate an appeal against a R158 million forfeiture order. The court threw out the application after the appeal lapsed, labelling Ndlovu’s justifications for the delay as “dishonest” and “superficial.”

The ruling cements a 2022 Special Tribunal decision which found that Ndlovu orchestrated a massive fraud during the COVID-19 pandemic.

Using eight fronting companies, he secured R172 million in PPE contracts from the National Health Laboratory Service (NHLS). However, the SIU discovered that nearly 90% of those funds approximately R158 million were never used for medical supplies.

Instead, the money was diverted to fund a lavish lifestyle for Ndlovu and his family, including high-end vehicles, luxury properties, and various private investments.

The High Court’s latest decision confirms that Ndlovu has no “prospects of success” in overturning the original ruling. This marks a significant victory for the SIU’s efforts to recover state funds misappropriated under emergency procurement rules.

The contracts have been officially declared unlawful, and Ndlovu remains legally bound to repay the R158 million gained through the scheme.
