The East London Regional Court has sentenced Economic Freedom Fighters (EFF) leader Julius Malema to five years’ direct imprisonment following his conviction for the discharge of a firearm.
- Count 1: 5 years’ imprisonment
- Count 2: 2 years’ imprisonment
- Count 3: R20 000 fine / 6 months imprisonment
- Count 4: R20 000 fine / 6 months imprisonment
- Count 5: R20 000 fine / 6 months imprisonment

Delivering the verdict in a crowded courtroom, Magistrate Twanet Olivier confirmed that the court had meticulously reviewed all defence submissions before reaching its conclusion.
In her ruling, Magistrate Olivier underscored that the sentence was designed to fit both the offender and the gravity of the crime, aiming to balance societal fairness with judicial mercy.
While acknowledging that Malema is a first-time offender, the magistrate remained firm on the seriousness of the violation.
The court rejected the defence’s attempt to characterise the incident as a harmless “celebratory shot” during the EFF’s anniversary event, describing such arguments as “nonsensical.”
Olivier noted that Malema was fully aware his actions were unlawful and that the discharge of the rifle was a pre-planned stunt rather than an impulsive act.
The magistrate further emphasised that the brief duration of the incident did not mitigate its potential for harm. She concluded that the leadership had approved the act well in advance, showing a blatant disregard for public safety that the court refused to condone.
