Drive 959 unpacks what keeps rental properties running smoothly and lawfully

Renting out a property in South Africa is more than just a business deal; it is a legal relationship.

Attorney Nonhlanhla Mtshali joined us on Drive 959 with Glen Lewis, Skhumba and Kgomotso to clear up the confusion that often leaves landlords in hot water.

Mtshali explained how a landlord’s main job is to provide a home that is safe and “fit to live in.”

This means keeping the structure sound and ensuring basic services like water work properly. When it comes to rent increases, they can’t just change the price on a whim. Hikes must be written into the lease or agreed upon during renewal, usually with a formal notice period.

She also shared how one of the biggest myths is that landlords can’t evict a tenant who doesn’t pay. They can, but they must follow the law. They are forbidden from cutting off electricity or locking tenants out.

She also encourages Drive 959 listeners who are renting a property that, in order to stay protected, they need to document everything and stick to the rules of the Rental Housing Act.
