The High Court in Pretoria has dismissed Thabo Bester’s attempt to be moved from the eBongweni Super Maximum Correctional facility.
Bester had filed an urgent application challenging his transfer to the Kokstad prison, arguing that his current placement severely hinders his legal defense.
Bester’s attorney, Moafrika wa Maila, argued that the relocation from Kgosi Mampuru Prison has created a logistical “suffering” for the legal team.
With only one month remaining before his trial for escaping the Mangaung Correctional Centre begins, Maila contended that the distance makes necessary consultations nearly impossible.
Despite these claims, Judge Mamoloko Kubushi ruled that the matter did not meet the requirements for the urgent roll.
The Department of Correctional Services opposed the move, and the court remained unconvinced that the situation necessitated an immediate intervention outside of regular court proceedings.
